Misuse of our services, including but not limited to unauthorized resale of products, infringement of our intellectual property, or any activity that harms the brand reputation of Arva Fashion Studio, is strictly prohibited.

• You are responsible for using the Arva Fashion Studio platform in accordance with all applicable local laws, especially those relating to online purchases, customer rights, personal styling services, and respectful conduct in digital spaces. 3. OUR SERVICE

1. Arva Fashion Studio provides a diverse portfolio of fashion and styling services designed to help individuals express their unique identity through curated clothing, personalized styling, and immersive fashion experiences. Our offerings cater to both online and offline audiences and aim to deliver a seamless, high-quality, and fashion-forward experience. Services provided by us include, but are not limited to, the following:

   • Personal Styling & Consultation: We offer one-on-one styling sessions virtual, or in-person led by experienced fashion consultants. These sessions focus on creating looks that align with a client’s lifestyle, body type, occasion, and personal aesthetic.

   • Curated Apparel: Arva designs curates premium fashion collections featuring clothing and accessories. Our selections reflect seasonal trends and timeless style, available through our online store, fashion events, or partner platforms.

   • Made-to-Measure & Custom Design Services: Clients can request bespoke garments or custom alterations through our studio. These services include fabric selection, tailoring to personal measurements, and outfit customization for events like weddings, parties, or professional appearances.

   • Pop-Ups, Exhibitions & Styling Events: We organize and participate in trunk shows, exhibitions, and experiential events, allowing customers to interact with our brand, explore new collections, and engage with stylists in curated environments.

   • Style Workshops & Image Mastery Sessions: Arva hosts workshops focused on personal branding, grooming, capsule wardrobes, and professional styling for individuals, corporates, and fashion enthusiasts seeking to refine their style sensibilities.

   • E-Commerce & Digital Experience: Our digital platform allows customers to explore collections, schedule styling sessions, place orders, and consume exclusive content such as fashion tips, trend forecasts, and behind-the-scenes insights.

   • Post-Purchase Support & Client Assistance: We offer after-sales support that includes order tracking, product care guidance, minor garment adjustments, and responsive client service for fashion-related queries, subject to our policies.

4. USER ACCOUNTS

1. To access certain features of the Arva Fashion Studio Platform such as booking styling consultations, placing custom orders, or attending workshops you may be required to create a user account. You agree to provide accurate, complete, and current information at the time of registration and to update such information promptly as needed.

2. By creating an account, you confirm that you meet the eligibility criteria outlined in Section 2 and that the information provided is truthful and not misleading. Providing false or outdated information may result in suspension or termination of your account at our discretion.

3. You are solely responsible for maintaining the confidentiality of your account credentials, including your login ID and password. All activities carried out using your account will be deemed to have been authorized by you. If you suspect any unauthorized use of your account, you must notify us immediately at contact@arvafashion.com.

4. We recommend that you use a strong password and change it periodically. Arva Fashion Studio will not be responsible for any loss or damage arising from your failure to adequately safeguard your account information.

5. We reserve the right to suspend or terminate your account and access to our Services at any time, without prior notice, in the following cases:

   • Violation of these Terms;

   • Engagement in fraudulent, abusive, or unlawful activities;

   • Non-payment of any applicable charges (if any);

   • Provision of false or misleading information;

   • Prolonged inactivity of your account;

6. Upon termination, you will lose access to all features, bookings, styling history, or saved preferences associated with your account. Clauses relating to intellectual property, disclaimers, liability, and indemnity will survive the termination.

8. You may delete your account at any time via your account settings. This will result in the permanent deletion of your account data, except where retention is required under applicable law or for legitimate business interests.

5 . USER RESPONSIBILITIES

1. Responsibilities of the User:

   • You are responsible for providing accurate and complete personal details, measurements, preferences, and event-specific requirements essential for us to deliver styling consultations, custom orders, or event services effectively. Any incorrect or outdated information may affect the quality, fit, or outcome of the service.

   • You must be available for scheduled appointments, fittings, or styling sessions and respond promptly to design or order approvals. Delays or non-responsiveness may impact delivery timelines, for which we shall not be held responsible.

   • You agree to use our services respectfully and legally, and not for any fraudulent, harmful, or unlawful purposes. You must treat our staff, platform, and premises with respect and refrain from behaviour that may harm our reputation or operations.

2. Exclusions:

   • Third-Party Services and Integrations: Arva Fashion Studio may suggest or use third-party tools, fabrics, accessories, or services as part of your styling experience, but we are not liable for their performance, quality, or availability. Any issues must be resolved with the respective third-party provider.

   • No Warranty for User-Provided Solutions: If you supply your own materials (e.g., fabrics, accessories, designs), Arva Fashion Studio offers no warranty or guarantee regarding their quality, performance, or compatibility with our services. We are not responsible for any issues or defects arising from user-provided items.

6. PROHIBITED ACTIVITIES

Users agree not to engage in any of the following activities while availing services from Arva Fashion Studio:

1. Users must not engage in unlawful activities, solicit others for illegal acts, or violate local, state, or international regulations, including any actions that contravene Arva Fashion Studio’s terms of service or applicable laws.

2. Users are prohibited from infringing Arva Fashion Studio’s intellectual property rights or those of any third parties, including unauthorized reproduction, distribution, or use of designs, content, or proprietary materials without prior written consent.

3. Any form of harassment, abusive conduct, discrimination, defamation, or any inappropriate communication, verbal or written, directed towards Arva Fashion Studio’s team or platform users is strictly forbidden and may result in service termination.

4. Users must not attempt to interfere with, damage, or misuse Arva Fashion Studio’s digital tools, booking systems, or communication channels, including engaging in activities that could harm or disrupt the service or its functionalities.

5. Impersonating others, providing false information, or using the services for unauthorized commercial resale or illegal purposes is prohibited and may lead to the suspension or termination of access to Arva Fashion Studio’s services.

6. Users must refrain from activities such as spamming, phishing, scraping, or gathering personal data without permission, or using any service features to track, collect, or harvest personal information unlawfully.

Users engaging with Arva Fashion Studio’s services agree to maintain respectful, lawful, and ethical behaviour throughout their interaction with the Studio, its representatives, and any associated platforms. The following conduct is strictly prohibited:

1. Users must not share, reproduce, or utilize any styling concepts, lookbooks, content, or materials belonging to Arva or third parties without proper authorization.

2. Users shall not post, share, or communicate any defamatory, obscene, vulgar, threatening, or discriminatory material through any medium associated with Arva’s services or social media platforms.

3. Users must not impersonate any individual, provide false personal details, or misrepresent their identity or intentions in any consultation, workshop, or booking.

4. Users shall refrain from sharing content or engaging in conduct that threatens public order, promotes unsafe beauty or fashion practices, or violates decency norms.

5. Users must not engage in any form of fraud, unauthorized payment activity, phishing, or deception in relation to service bookings, product usage, or event participation.

6. Users must maintain a courteous, respectful, and professional tone in all interactions with Arva’s team. Any form of harassment, abusive language, or inappropriate behaviour will result in immediate service suspension. 

7. If sharing images styled or created by Arva, users must provide proper credit and refrain from editing or misusing such content in a misleading or defamatory context.

8. INTELLECTUAL PROPERTY RIGHTS

At Arva Fashion Studio, our creative expression is at the heart of what we do. From signature styling methods to curated looks and original content, we protect our intellectual property with care. Please note the following:

1. All rights, titles, and interests in and to our designs, styling templates, digital content, branding elements (including logos, taglines, and brand visuals), lookbooks, tutorials, training modules, photoshoots, and any other proprietary material are the exclusive intellectual property of Arva Fashion Studio. By engaging with our services, you receive a limited, non-exclusive, non-transferable right to use this material solely for personal, non-commercial purposes related to our offerings.

2. You are welcome to use our materials to the extent necessary to avail of our styling consultations, training, or digital products. You may not modify, copy, publish, share, or create derivative works from any of our content without our explicit written consent.

3. You must not:

   • Copy or redistribute Arva’s content, looks, designs, or styling guides for public or commercial use.

   • Alter or remove any copyright, watermark, or proprietary notices.

   • Use Arva’s brand name, logo, or design concepts for endorsement, resale, or promotional purposes without written authorization.

   • Participate in any conduct that may dilute or damage Arva Fashion Studio’s brand identity or reputation.

4. We take violations seriously. Any unauthorized use of Arva’s intellectual property may result in suspension of services and legal recourse, including, but not limited to, injunctive relief and compensation for damages.

9. PRIVACY POLICY

1. At Arva Fashion Studio, we value the privacy of our customers. We firmly believe that your personal information should not be shared with third parties without your explicit consent. Privacy is a fundamental right, and we are committed to safeguarding your information.

2. Information We Collect: We collect personal information such as contact details (e.g., phone number, email address, and mailing address) solely for internal purposes. This information helps us to communicate with you regarding our latest deals, collections, and other relevant updates.

3. Use of Information: The contact information you provide is stored securely in our database and will be used exclusively to keep you informed about new arrivals, promotions, and any important updates. 10. REFUND AND CANCELLATION POLICY

1. Customers can cancel their order within 6 hours of placement. Refund requests will be processed within 10 working days through the same payment method used for the original transaction. Cancellations and refunds are subject to approval.

2. Every garment is made to order and customised just for you; therefore, we do not accept returns once a product is delivered.

3. Exchanges are allowed within 7 days of delivery only if there’s a manufacturing defect, you received the wrong item, or a customised garment doesn’t fit (one-time free alteration offered). Minor colour variations and major design changes are not covered.

4. How to contact: Email at contact@arvafashion.com within 24 hours of delivery. Items must be unused, with tags intact, in original packaging, and shipped via registered courier with tracking retained until delivery is confirmed.

11. PAYMENT

1. To pay for services, you must provide a valid payment method, including credit cards, debit cards, or bank transfers. Other payment options available on our platform may also be used to complete transactions for services provided.

2. By confirming a service request, you authorize Arva Fashion Studio to charge the selected payment method for the total service fee, including any applicable taxes or additional charges, in accordance with these payment terms, which are part of our agreement.

3. All payments are processed through third-party payment gateways. Once payment is successfully processed, your payment obligation for the service is considered fulfilled, and no further action will be required from your side unless a failure occurs.

4. In the event of a payment failure, Arva Fashion Studio or the payment gateway provider may attempt to recover the outstanding amount. We will contact you via email or phone to resolve payment issues or initiate necessary collection actions.

12. DISCLAIMER AND LIMITATION OF LIABILITY

1. Arva Fashion Studio does not guarantee, represent, or warrant that the use of our services will be uninterrupted, timely, secure, or error-free. The service and all products provided are "as-is" and "as-available," without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. We do not guarantee that the results obtained from the use of our services will be accurate, reliable, or meet your expectations. You agree that your use of our services is at your sole risk.

3. We are not liable for any delays, failures, or issues in service delivery, including but not limited to data loss, system malfunctions, or technical issues caused by third parties, such as viruses, unauthorized access, or disruptions beyond our control.

4. We shall not be liable for any third-party products, services, or content accessed through our platform. Any reliance on third-party offerings is solely at your own discretion and risk.

5. To the fullest extent permitted by law, Arva Fashion Studio’s total liability for any claims arising from your use of our services shall not exceed the amount paid by you for the specific product or service that led to the claim within the last twelve (12) months.

6. In no event shall Arva Fashion Studio, its proprietor, partners, officers, employees, agents, contractors, suppliers, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from your use of the services or products obtained through our platform, even if advised of the possibility of such damages.

 

13. INDEMNIFICATION

1. You agree to indemnify, defend, and hold harmless Arva Fashion Studio, its affiliates, officers, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and legal expenses (including reasonable attorney fees) that arise from or are related to:

   1. Your failure to comply with these Terms and Conditions, any related policies, or any agreements made with Arva Fashion Studio.

   2. Any violations of applicable laws, regulations, or third-party rights, including but not limited to intellectual property, privacy, and contractual rights.

   3. Unauthorized use or misuse of Arva Fashion Studio's platform, services, or products by you or any individual accessing your account, whether with or without your knowledge or consent.

   4. Any claims related to content you provide, share, or post through Arva Fashion Studio, including but not limited to defamation, copyright infringement, or violations of third-party rights.

   5. Any incidents involving your account, services, or systems, including security breaches, unauthorized access, or other issues that arise from your actions, omissions, or negligence.

   6. Disputes or claims arising from your interactions with third-party vendors, service providers, or entities through Arva Fashion Studio’s platform, including any obligations or agreements made outside of the scope of Arva Fashion Studio’s services.

 

14. DISPUTE RESOLUTION

1. In the event of any dispute or difference arising between the Firm and the User, both parties agree to first attempt to resolve the issue through open communication and mutual understanding. If these efforts fail, the matter shall be referred to mediation.

2. If mediation does not lead to a resolution, the dispute shall be resolved through arbitration, with a sole arbitrator appointed in accordance with the Arbitration and Conciliation Act, 1996, at a location to be mutually agreed upon.

3. The decision of the arbitrator shall be final and binding on both parties.

4. This Agreement shall be governed by the laws of India, without applying conflict of law principles. Any legal actions or claims relating to this Agreement shall be exclusively initiated in the courts located in Nagpur, Maharashtra, which shall have exclusive jurisdiction.

5. Both parties agree that any dispute will be resolved individually and not as part of a class or collective action.
